Terms of Service

By accessing, installing, or using the Depot Khmer mobile application and services, you agree to comply with and be bound by the following Terms of Service. If you do not agree with any part of these terms, please uninstall the application and discontinue use immediately.

2.1. Account Registration and Security

  • Accuracy: You agree to provide accurate, truthful, and complete information when registering an account.
  • Account Responsibility: You are solely responsible for all actions taken under your credentials. Keep your login tokens, passwords, and sessions secure.
  • Suspension: We reserve the right to suspend or terminate accounts that provide false contact information, use disposable accounts, or engage in suspicious behaviors.

2.2. User-Generated Content (UGC) Policy

Depot Khmer allows users to upload listing descriptions, product details, images, and feedback messages. You retain ownership of your content, but grant Depot Khmer a worldwide, royalty-free license to host, display, and distribute it on our platform.

A. Prohibited Content

You are strictly prohibited from posting, transmitting, or uploading content that:

  • Contains illegal materials, weapons, narcotics, explosives, or regulated substances.
  • Contains adult content, explicit pornography, nudity, or sexually suggestive imagery.
  • Promotes discrimination, hate speech, violence, harassment, or defamation.
  • Infringes on the intellectual property, copyright, patent, trademark, or privacy rights of any third party.
  • Constitutes spam, commercial promotions outside of marketplace parameters, or malicious code.

B. Moderation and Enforcement

  • Right of Removal: Depot Khmer operates a zero-tolerance policy towards objectionable content. We reserve the absolute right to remove, edit, or reject any listing or content that violates these Terms without prior warning.
  • User Ban: Users who repeatedly violate the UGC policy will face immediate and permanent device and account suspension.

2.3. Marketplace Transactions Disclaimer

  • No Agency: Depot Khmer acts purely as a classifieds hosting platform connecting independent buyers and sellers. We do not participate in, broker, guarantee, or process payments for the actual transactions between users.
  • No Warranties: We do not inspect, verify, or guarantee the quality, safety, authenticity, legality, or description of items posted on our platform. All negotiations and transactions are handled directly between the buyer and seller.
  • Assumption of Risk: Users assume all risks associated with dealing with other individuals, local meetups, and financial transfers. Depot Khmer is not responsible for any financial loss, fraud, or damage resulting from transactions.

2.4. Subscriptions and Plan Limits

  • Tier Limitations: Depot Khmer offers Free and Premium subscription tiers.
  • Limits Check: Usage limits (such as the number of listings allowed, maximum images per post, and active validation timelines) are enforced by system algorithms.
  • Upgrades: When your account hits its post or image thresholds, you will receive a block screen guiding you to upgrade your plan.
  • No Refunds: Payments for package upgrades are processed securely through app store frameworks or standard channels. All upgrades are final and non-refundable, unless required by local consumer laws.

2.5. Intellectual Property Rights

All app elements, including but not limited to source code, graphics, layout designs, user interface elements, animations, logos, trademark styles, database structures, and branding are the exclusive property of Depot Khmer. You may not copy, reverse engineer, extract, or reuse any part of the Depot Khmer software without written consent.

2.6. Limitation of Liability

To the maximum extent permitted by applicable law, Depot Khmer and its developers, employees, or directors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, loss of profits, loss of data, reputation loss, transaction disputes, or physical injury resulting from your use of the Service or transactions arranged via the app.

2.7. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the Kingdom of Cambodia. Any dispute arising from or relating to these terms or use of the application shall be submitted to the exclusive jurisdiction of the competent courts of Phnom Penh, Cambodia.
